1. Acceptance of these Terms
These Terms of Service ("Terms") govern your access to and use of the XAUUSD Trading Mentor mobile application, also referred to as "XAUUSD-TM," "the App," "we," "us," or "our." By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Who we are
The App is published by Basel Abu Al Asal. Questions about these Terms can be sent to alasalbasel@gmail.com.
3. Eligibility
The App is intended for adults and is not directed to children under 18. By using the App, you confirm that you are at least 18 years old and legally able to enter into these Terms in your jurisdiction.
4. Description of the service
The App provides:
- Trading-session information and daily buy/sell levels for the Tokyo, London, and New York sessions for gold (XAUUSD);
- A trading guide and general educational content;
- Push and local notifications related to session status and app announcements;
- Optional paid subscriptions that unlock the daily levels and trading guide.
Daily levels and guidance are published at the discretion of the App's administrator and may change, be delayed, or be unavailable at any time without notice.
5. Not financial advice — risk disclosure
The App does not provide financial, investment, trading, or brokerage advice. All levels, notes, guides, and other content are provided for general informational and educational purposes only. Trading gold (XAUUSD) and other financial instruments involves substantial risk of loss and is not suitable for every person. You are solely responsible for your own trading decisions, and you should not rely on the App as the sole basis for any trade. Past performance and published levels are not a guarantee of future results. Trade at your own risk.
6. Accounts and administrator access
Regular users are not required to create an account to use the App. The App includes a restricted, single-administrator function used to publish daily levels and notifications; this function is not available to regular users and is not an account system for the general public.
7. Subscriptions and payments
Certain features, including daily levels and the trading guide, require an active paid subscription. Subscriptions are sold and billed through the Apple App Store or Google Play, and are subject to each platform's own payment terms.
- Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period.
- Your payment method will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage or cancel your subscription at any time from your device's App Store or Google Play account settings.
- Prices, billing periods, and available plans are set and displayed by the App Store / Google Play and may change; the current price is always shown in the App before purchase.
- Refunds are handled by Apple or Google according to their own refund policies — we do not process payments or refunds directly.
8. Acceptable use
You agree not to:
- use the App for any unlawful purpose or in violation of these Terms;
- attempt to gain unauthorized access to the administrator function, other users' data, or the App's backend systems;
- interfere with, disrupt, or reverse-engineer the App or its underlying services;
- redistribute, resell, or publicly republish daily levels, guides, or other App content without permission.
9. Intellectual property
The App, including its design, text, graphics, logos, and underlying software, is owned by or licensed to us and is protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the App or its content — only a limited, personal, non-transferable right to use the App in accordance with these Terms.
10. Third-party links and services
The App may link to third-party services, such as a broker's website or Telegram. Those services operate independently, and we are not responsible for their content, availability, or practices. The App also relies on third-party providers, including Google Firebase (data, authentication, notifications) and RevenueCat / Apple / Google (subscriptions), to operate — availability of the App depends on these services functioning correctly.
11. Disclaimer of warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to accuracy, completeness, timeliness, or fitness for a particular purpose. We do not warrant that levels or notifications will be delivered without delay or error, or that the App will be uninterrupted or error-free.
12. Limitation of liability
To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any trading losses, lost profits, or lost data, arising from or related to your use of, or inability to use, the App — even if we have been advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
13. Termination
We may suspend or discontinue the App, or any part of it, at any time. You may stop using the App at any time by uninstalling it and, if applicable, canceling your subscription through the App Store or Google Play. Sections of these Terms that by their nature should survive termination (including Sections 5, 9, 11, and 12) will continue to apply.
14. Changes to these Terms
We may update these Terms from time to time to reflect changes to the App, our service providers, or legal requirements. The updated Terms will be posted at this URL with a revised effective date. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws applicable in Jordan, without regard to conflict-of-law principles, except where mandatory local consumer-protection law provides otherwise based on your place of residence.
